COMPUDON Season XI Official Rules

NO PURCHASE NECESSARY TO PARTICIPATE OR WIN. VOID WHERE PROHIBITED.

CHAMPIONSHIP IS OPEN TO THE DIRECT AND INTENDED RECIPIENTS OF INDIA HAMPIONSHIP IS OPEN TO THE DIRECT AND INTENDED RECIPIENTS OF CYBERLEARNING EDUCATIONAL SOCIETY (ORGANIZER) THOSE HAVE PARTICIPATED IN A QUALIFYING ROUND AND WHO ARE RESIDENTS OF INDIA. IF YOU DO NOT MEET THE ELIGIBILITY CRITERIA OR IF YOU DID NOT PARTICIPATE IN A QUALIFYING ROUND (FOR AN ELIGIBLE EXAM ENTERED IN A QUALIFYING ROUND BETWEEN SEPTEMBER 15, 2021 AND APRIL 30, 2022) YOU ARE NOT ELIGIBLE TO PARTICIPATE IN THIS CHAMPIONSHIP.

PARTICIPATION IN THIS CHAMPIONSHIP CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES.

In order to participate in the COMPUDON Championship/ MOS India Championship/ MOS World Championship (the “Championship”), you must agree to these Rules. Therefore, please read these Rules prior to participating to ensure you understand and agree. You agree that participating in the Championship constitutes your agreement to these Rules. You may not participate in the Championship and are not eligible to receive any prize described in these Rules unless you agree to these Rules. These Rules form a binding legal agreement between you and Sponsor with respect to the Championship.

To be eligible to participate in the Championship, you must: (1) be between the ages of 13 and 22 as of June 15, 2022 (and if you are an eligible minor you must have the permission from your parents or legal guardians to participate in the Championship); (2) be enrolled in an approved academic institution (as defined by Sponsor in its sole discretion); (3) not be a person or entity under U.S. export controls or sanctions. Employees, interns, contractors, and official office-holders of Sponsor, CyberLearning, Pearson Vue, Microsoft, Inc., Certiport, Inc., and their respective parent companies, subsidiaries, affiliates, and their respective directors, officers, employees, advertising and Championship agencies, representatives, and agents (collectively, “Championship Entities”), and members of the Championship Entities immediate families (parents, siblings, children, spouses, and life partners of each, regardless of where they live) and members of the households (whether related or not) of such Championship Entities are ineligible to participate in this Championship.

Sponsor reserves the right to verify eligibility and to adjudicate on any dispute at any time. Entrants who have previously won any prize (the top 3 prizes) in the India Finals are not eligible to compete in the same product track (e.g. Excel, Word, or PowerPoint), even if it is a different version of that product, but may compete in a different product track (e.g. a previous competitor in the Excel product track can only compete in the Word or PowerPoint product tracks).

COMPUDON is sponsored by CyberLearning, with registered office at Krishan Nagar, Delhi.

The qualification round ends on April 30, 2022. Results of Level 1 (qualification round) will be declared on May 04, 2022 on COMPUDON website. India Finals exam and India Award Ceremony will happen in 2nd/3rd week of May, 2022 HOW TO PARTICIPATE IN THE CHAMPIONSHIP

There will be two rounds in the championship

1st Round -students will take a MOS qualifying exam within their institution or at a location on date & time specified by the Sponsor

2nd Round will be India Finals Round -qualifying students will be invited to India Finals which will most likely take place in Mumbai in 2nd/ 3rd week of May 22, 2022.

Entrants may take more than one exam/ exams in more than one track but they will have to select a single exam track after qualification/ 1st round. Entrants will be required to test in English language only. NO other language is available.

During the Qualifying Round, eligible entrants will take the eligible exam based on the Microsoft Office Application, in which they want to complete in the eligible versions (2016 OR 2019)

In qualifying round, Entrants will compete in one (1) of the following six (6) Exam categories (each, an exam based on MS Office Application (MOS EXAM) in eligible versions); (i) 2016 Word; (ii) 2016 PowerPoint; (iii) 2016 Excel; (iv) 2019 Word; (v) 2019 PowerPoint; or (vi) 2019 Excel.

The 2nd Round- qualifying entrants will compete in one (1) of the following six (6) Exam categories (each, an exam in eligible versions); (i) 2016 Word; (ii) 2016 PowerPoint; (iii) 2016 Excel; (iv) 2019 Word; (v) 2019 PowerPoint; or (vi) 2019 Excel.

In this round, Entrants will receive a set of guidelines (printed/on screen) containing specification for the document, workbook, or presentation, and data files that can be used as building blocks to speed up the recreation of the document, workbook, or presentation. Entrants will be allowed up to fifty (50) minutes to recreate the document, workbook, or presentation they are provided. This may be or may not be a MOS exam. Sponsor reserves to alter the final exam but without changing the exam objectives.

All exams must be completed at the Event within the fifty (50) minute time period specified to be considered. Exams received from any person in excess of the above stated limitation will be void. Exams are void if they are in whole or part incomplete, altered, counterfeit, obtained through fraud, or late.

The qualification criteria to go to next round of the championship is highest score in the previous round. In the event of a tie, the entrant that completed the applicable exam in the shortest amount of time (as determined by Organizer, in its sole discretion) will be selected as the potential winner. In the event a potential winner is disqualified for any reason, the candidate for the applicable exam that received the next highest score will be chosen as the potential winner.

All exams must be completed within the fifty (50) minute time period specified to be considered. Exams are void if they are in whole or part incomplete, altered, counterfeit, obtained through fraud, or late.

At the conclusion of the Championship Period, the one (1) exam that receives the highest overall score in each exam category will be deemed a potential First Prize winner (for a total of six (6) potential First Prize winners).

The one (1) exam that receives the next highest overall score in each exam will be deemed a potential Second Prize winner (for a total of six (6) potential Second Prize winners). The one (1) exam that receives the next highest overall score in each exam will be deemed a potential Third Prize winner (for a total of six (6) potential Third Prize winners). In the event of a tie, the entrant that completed the applicable exam in the shortest amount of time (as determined by Organizer, in its sole discretion) will be selected as the potential winner of the applicable exam. In the event a potential winner is disqualified for any reason, the exam for the applicable Exam that received the next highest total score will be chosen as the potential winner.

At the conclusion of the Championship Period, the one (1) exam that receives the highest overall score in each exam category will be deemed a potential First Prize winner (for a total of six (6) potential First Prize winners).

In the event of a tie, the entrant that completed the applicable exam in the shortest amount of time (as determined by Organizer, in its sole discretion) will be selected as the potential winner of the applicable exam. In the event a potential winner is disqualified for any reason, the exam for the applicable Exam that received the next highest total score will be chosen as the potential winner.

WINNER NOTIFICATION: A day after India finale exam, the potential winners will be announced during the Awards Ceremony. If a potential winner does not attend the Awards Ceremony, then such potential winner may be disqualified and an alternate potential winner may be selected from among all eligible exams received based on the winner procedure described herein. Winners will be notified by phone/sms at the number provided during final exams.
Except where prohibited by law, each potential winner may be required to sign and return a Declaration of Eligibility and provide any additional information that may be required by Organizer.

All notification requirements, as well as other requirements within these Rules, will be strictly enforced. In the event that no exams are received, no prize will be awarded. Determinations of Organizer are final and binding.

No transfer, substitution or cash equivalent for prizes is allowed, except at Organizer’s/ Sponsor’s sole discretion. Organizer reserves the right to substitute a prize, in whole or in part, of equal or greater monetary value if a prize cannot be awarded, in whole or in part, as described for any reason. Championship Entities have not made and Championship Entities are not responsible in any manner for any warranties, representations, or guarantees, express or implied, in fact or law, relating to the prize, regarding the use, value or enjoyment of the prize.

QUALIFYING INDIA CHAMPIONS WHO QUALIFY FOR INDIA TEAM FOR PARTICIPATION IN MOS WORLD FINALS MUST BE AVAILABLE TO TRAVEL TO USA ALONG WITH THE MOS INDIA TEAM ON THE SPECIFIED DATE AND TIME TO PARTICIPATE IN THE MOS WORLD CHAMPIONSHIP AND RETURN BACK TO INDIA ALONG WITH THE TEAM ON THE SPECIFIED DATE AND TIME. IN CASE OF ANY EXCEPTIONS ORGANIZERS WILL NOT BE RESPONSIBLE FOR ANY EXPENSES INCLUDING BUT NOT LIMITED TO THEIR AIRFARE, ACCOMMODATIONS, ETC. AND ANY EXPENSES NOT EXPLICITLY LISTED HEREIN, ARE THE SOLE RESPONSIBILITY OF THE WIINER. TRAVEL IS SUBJECT TO AVAILABILITY & VISA AND MUST BE COMPLETED ON DATES SPECIFIED BY ORGANIZER

IF A FAMILY MEMBER OF CANDIDATE WHO QUALIFIES ON INDIA TEAM FOR WORLD CHAMPIONSHIP/ FACULTY MEMBER OF THE INSTITUTE PRODUCING SUCH WINNER WISHES TO ACCOMPANY THE CANDIDATE TO THE MOS WORLD CHAMPIONSHIP, HE/SHE MAY DO SO AT THEIR OWN COST WHICH INCLUDES BUT MAY NOT BE LIMITED TO RETURN AIRFARE, VISA, ACCOMODATION, TRAVEL, ENTRY FEES ETC.

RECEIPT OF PRIZES BY POTENTIAL WINNERS ARE SUBJECT TO THE EXPRESS REQUIREMENT THAT THEY SUBMIT TO ORGANIZER ALL DOCUMENTATION REQUESTED BY ORGANIZER TO PERMIT IT TO COMPLY WITH ALL APPLICABLE TAX LAWS AND WITHHOLDING REQUIREMENTS. ALL PRIZES WILL BE NET OF ANY TAXES ORGANIZER IS REQUIRED BY LAW TO WITHHOLD. ALL TAXES IMPOSED ON PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNERS.

In order to receive a prize, potential winners may be required to submit the tax documentation requested by Organizer or otherwise required by applicable law, to Organizer or the relevant tax authority, all as determined by applicable law, including, where relevant. The potential winners are responsible for ensuring that (s)he complies with all the applicable tax laws and filing requirements.

If a potential winner fails to provide such documentation or comply with such laws, the prize may be forfeited and Organizer may, in its sole discretion, select an alternative potential winner.

THE ORGANIZERS RESERVE THE UNQUESTIONABLE RIGHT TO DISQUALIFY OR REJECT ANY ENTRY THAT DOES NOT MEET THE ABOVE CRITERIA. THE DECISION OF THE ORGNIZERS SHALL BE FINAL IN THIS REGARD. IF SUFFICIENT NUMBER OF ENTRIES MEETING THE ENTRY REQUIREMENTS ARE NOT RECEIVED/ AVAILABLE, ORGANIZERS MAY, AT THEIR SOLE DISCRETION & WITHOUT ANY OBLIGATION TO ANYONE WHATSOEVER, SELECT FEWER THAN THE DESIGNATED NUMBER OF WINNERS. THE DECISIONS OF THE JUDGES WILL BE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CHAMPIONSHIP.

All applicable local laws and regulations apply. Organizer reserves the right to disqualify any participant from the Championship if, in Organizer’s sole discretion, it reasonably believes that the participant has attempted to undermine the legitimate operation of the Championship by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other participants, viewers, Organizer, or the Judges.

To ensure wider participation, ORGANIZER reserves an absolute and unquestionable right to restrict the number of entries per institute/ testing center in the India finals. NO enquiries or petitions in this regard will be entertained. Odds of winning in the championship will depend on the number of eligible entries received and the level of skill of each participant.

The venue for 2022 India Finals will most likely be Mumbai. Students who qualify for India Finals will have to make their own arrangements to appear in India Finals.

Foreign students, who are enrolled in an accredited academic institution in India are eligible to participate, with an agreement that should they become the winners of the India Finals and be organized to compete at the 2022 MOS WORLD CHAMPIONSHIP they will be representing India and not the country of their nationality, birth, or otherwise. No substitution/transfer/assignment of prize by any winner is permitted.

BECOMING INDIA CHAMPION DOESN’T MEAN AUTOMATIC SELECTION IN THE INDIA TEAM FOR MOS WORLD CHAMPIONSHIP. ADDITIONAL QUALIFYING CRITERIA APPLY FOR QUALIFICATION IN THE INDIA TEAM FOR MOS WORLD CHAMPIONSHIP.

India Champion who qualify for MOS World Championship must also be available for all training sessions arranged by ORGANIZER before the world championship. Unavailability of the winners may lead to their disqualification for participation in MOS World Championship and ORGANIZER, at its own discretion may select the next qualifying participant. ORGANIZER shall bear the expenses for travel to MOS World Championship. All other expenses at any time shall be the sole responsibility of the participant. India Team will depart and return to Delhi/ Mumbai as the case may be, and it will be the responsibility of each India Team Member (student) to reach Delhi/ Mumbai at his/her own expense. Departure airport from Delhi/ Mumbai will be notified well in time.

All travelers must execute a “Release of Liability” prior to ticketing and must possess required travel documents (e.g. valid photo I.D, passport, visa, overseas medical insurance etc.) prior to the trip, which will be the responsibility of the participants/their parents.

Certiport shall provide the VISA Invitation Letter for the US Embassy for INDIA TEAM MEMBERS. ORGANIZER’s responsibility will be limited to pay for Return Airfare Ex Delhi/Mumbai, Accommodation at World Finals Event, Meals and Local Transport in USA to attend the MOS World Championship for the India Team. All other expenses including Visa Application Fees, travel to Delhi/ Mumbai, Medical Insurance etc. for MOS WORLD CHAMPIONSHIP will be the responsibility of the participant.

If the India Championship or the MOS World CHAMPIONSHIP is cancelled for any reason, ORGANIZER shall have no obligation to the participants. If winner is a minor, ORGANIZER will require winner’s parent(s) or legal guardian (as the case may be) to sign all required forms on winner’s behalf. If winners do not complete the required forms as instructed and/or return the required forms within the time period listed on the winner notification message, ORGANIZER may disqualify the winner and select the next qualifying participant without notice.

ORGANIZER, at its own discretion, may provide all the travelers/India Champions with India Team jersey/uniform. If so provided, all travelers MUST wear their INDIA TEAM jersey/uniform at all times during their travel to the WORLD CHAMPIONSHIP and for all the interviews, photo coverage, or any media activity related to their participation in the Championship.

Participant acknowledges and agrees that Organizer may collect, store, share and otherwise use any personally identifiable information provided to Organizer throughout the Championship, including, but not limited to, name, photos, mailing address, date of birth, email address, and any financial information collected to facilitate awarding any applicable prize including for administering the Championship and verifying a participant’s identity, postal address and email address in the event a participant qualifies for a prize.

Participant has the right to request access, review, rectification or deletion of any personal data held by Organizer in connection with the Championship by writing to Organizer at this email address; info@compudon.in

Finalists will be required to download their Admit Cards for India Finals and will be required to accept terms including Release of Liability etc. prior to India Finals. Finalists will be required to carry the Admit Card to the Finals venue; participants without the Admit Card will not be allowed to enter the exam hall.

It is STRONGLY recommended that all India finalists (who do not have their valid passports) apply for their passports immediately on making to India finals round. For India Champions, it is MANDATORY that they, without any notice from ORGANIZER must submit copies of their valid passports to ORGANIZER on or before May 25, 2022, where the passport must be valid till December 31, 2022. In case INDIA TEAM MEMBER fails to submit his/her passport as above, then ORGANIZER at its sole discretion, and without notice, may allow the next qualifying participant to represent India at the worldwide finals.

By accepting a prize, participant agrees to Organizer and its agencies use of his or her name and/or likeness and photo (if applicable) for advertising and promotional purposes without additional compensation, unless prohibited by law.

To the maximum extent permitted by law, each participant indemnifies and agrees to keep indemnified Championship Entities at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the participant and/or a breach of any warranty set forth herein.

To the maximum extent permitted by law, each participant agrees to defend, indemnify and hold harmless the Championship Entities from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorney’s fees) arising out of or accruing from (a) any exam or other material uploaded or otherwise provided by the participant that infringes any copyright, trademark, trade secret, trade dress, patent or other intellectual property right of any person or defames any person or violates their rights of publicity or privacy, (b) any misrepresentation made by the participant in connection with the Championship; (c) any non-compliance by the participant with these Rules; (d) claims brought by persons or entities other than the parties to these Rules arising from or related to the participant’s involvement with the Championship; (e) acceptance, possession, misuse or use of any prize or participation in any Championship-related activity or participation in this Championship; (f) any malfunction or other problem with the Championship Site; (g) any error in the collection, processing, or retention of exam information; or (h) any typographical or other error in the printing, offering or announcement of any prize or winners.

Any false information provided within the context of the Championship by any participant concerning identity, mailing address, telephone number, email address, ownership of right or non-compliance with these Rules or the like may result in the immediate elimination of the participant from the Championship.

Championship Entities are not responsible for any malfunction or for any late, lost, damaged, misdirected, incomplete, undeliverable, or destroyed exams due to system errors, failed, incomplete or garbled computer or other telecommunication transmission malfunctions, hardware or software failures of any kind, lost or unavailable network connections, typographical or system/human errors and failures, technical malfunction(s) of any telephone network or lines, cable connections, satellite transmissions, servers or providers, or computer equipment, traffic congestion on the Internet or at the Championship Site, or any combination thereof, including other telecommunication, cable, digital or satellite malfunctions which may limit an participant’s ability to participate.

If for any reason the Championship is not capable of running as planned, including, without limitation, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Championship, Organizer reserves the right at its sole discretion to cancel, terminate, modify or suspend the Championship and if terminated, Organizer will determine the potential winners for the Championship from among all eligible exams received prior to action taken using the judging criteria specified above OR may decide on the basis of a personal interview of the candidates. Organizer further reserves the right to disqualify any participant who tampers with the submission process or any other part of the Championship or Championship Site. Any attempt by an participant to deliberately damage any web site, including the Championship Site, or undermine the legitimate operation of the Championship is a violation of criminal and civil laws and should such an attempt be made, Organizer reserves the right to seek any and all remedies available from any such participant to the fullest extent of the applicable law.

Under no circumstances shall the submission of an exam into the Championship, the awarding of a prize, or anything in these Rules be construed as an offer or contract of employment with either Organizer, or the Championship Entities. You acknowledge that you have submitted your exam voluntarily and not in confidence or in trust. You acknowledge that no confidential, fiduciary, agency or other relationship or implied-in-fact contract now exists between you and Organizer or the Championship Entities and that no such relationship is established by your submission of an exam under these Rules.

These Rules shall be governed by, subject to, and construed in accordance with the laws of India excluding all conflict of law rules. If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. To the extent permitted by law, the rights to litigate, seek injunctive relief or make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Championship are hereby excluded, and all Participants expressly waive any and all such rights.

As between Sponsor and the participant, the participant retains ownership of all intellectual and industrial property rights (including moral rights) in and to their exam. As a condition of exam, participant grants Sponsor, its subsidiaries, agents and partner companies, a perpetual, irrevocable, worldwide, royalty-free, and non- exclusive license to use, reproduce, adapt, modify, publish, distribute, publicly perform, create a derivative work from, and publicly display their participation in the Championship in connection with advertising and Championship via communication to the public or other groups.

By entering the Championship, you agree that exclusive jurisdiction for any dispute, claim, or demand related in any way to the Championship will be decided by binding arbitration. All disputes between you and Organizer of whatsoever kind or nature arising out of these Rules, shall be submitted before sole arbitrator appointed by the Organizer. The parties agree to share equally in the arbitration costs incurred. The seat of Arbitration will be at New Delhi.

ORGANIZERS reserve an unconditional right to alter, amend, change and modify any and all the Rules and Regulations without prior notice. Such modifications, if any, will be uploaded on the championship website and will be binding on all participants.
